Acceptance of this Privacy Policy

This Privacy Policy document (“Privacy Policy”) concerns the information we collect when you use the On-Demand Services App (the “App”), website, and associated information, materials, resources, and P2P marketplace services (the “Services”). It describes the types of information we collect, how we use it, how we may disclose it, and our other privacy practices. 

You should review, understand, and agree to this Privacy Policy (and our Terms of Use) before you continue using the App. By your use of the App and the Services, you represent that you have read and agree to be bound by this Privacy Policy. Otherwise, you should stop using the Services. 

Definition of undefined Terms

  • Personal information means any information about a user, which can be used to identify them (e.g., name, email address, phone number, photo, etc.).
  • device refers to any device that can access the App or website, including mobile phones, computers, and tablets. 
  • you, your, and user all refer to any individual – whether a Service Provider, Client, or representative of an entity – that signs up on the App and uses the Services. 
  • Wokka, we, us, and our all refer to Wokka Technology, LLC, the provider of the App and the Services. 
  • Service Provider refers to any user who uses the App to list and provide on-demand services to Clients. 
  • Client refers to any user who uses the App to request or demand services from Service Providers. 

Information Collection

The information you provide: Depending on your use of the Services, you may be required to provide us with personal information, which may include your name, email address, mobile number, picture, home address, location, demographics, and the like. 

You may submit this information when you take actions like:

  • Signing up to use the Services as a Service Provider or Client.
  • Updating your profile information.
  • Providing your billing information to process your payments or earnings.
  • Using our contact information or the App to reach out to us.
  • Uploading documents used for self identification or service verification, such as Driver’s License, Insurance Papers, Professional Certification, and pictures of your services.
  • Providing information about the services you render as a Service Provider.
  • Submitting content, such as reviews, feedback, etc. after interacting with another user.
  • Authenticating your social media account for login purposes. 

If you operate a Corporate Collaboration account for Service Providers, you may be able to sign up and provide information on behalf of individuals in your team. The information may include the same information we may collect from individual Service Providers. 

There is no statutory obligation to provide us with the information you provide when you use the Services. However, if you do not provide us with some of this information, we may be unable to provide you with the Services. In some cases where the provision of a piece of information is not reliant on the Services, we make it optional (for example, a National Identification Number is optional for Service Providers). 

Under applicable laws, some of the information we collect may be regarded as “sensitive information.” Such types of information are collected solely with your consent, and extra protection is provided. 

The information we collect automatically: When you access the App and website, or when you interact with our content, we collect certain aggregated information automatically using cookies, pixels, beacons, and other similar technologies. The information we collect automatically may include: 

  • Usage and analytics information about the features you use, pages accessed, your search terms, ads clicked, duration of use, your referring URL, and similar behaviors on the App and website. 
  • Device properties, which may include your device IP address, internet service provider, operating system, and Ad ID. 
  • Geolocation obtained from your IP address.
  • Transactional information, which may include your purchases, amount paid, and date made. 

Aside from the IP address and other device properties, the information we collect automatically is categorized as non-personal information because it is in aggregated form (this means that the information is hashed or anonymized).

The information we collect from your permissions: To perform certain services, such as importing your files, matching you with users based on location, enabling in-app messages, and importing contacts, we will request access to certain features on your device. 

These features may include:

  • Precise location using the Google Maps API to determine your city and distance.
  • Push notifications to enable the messaging features between you and the users you interact with.
  • File manager and gallery to enable us to import files from your device. 

Where we collect any information based on your permission, you have the right to withdraw your permission at any time by using the settings found within your device settings. 

The information we collect from third-party sources: We may also collect information about you from third-party sources. For example, if you use any of the social media plugins on the login page to sign in, the applicable social media will provide us with the information you permit on the social media account to enable us to log you into the App and create a profile for you. You can block this action at any time by using the privacy settings on the applicable social media account. 

Cookies and Similar Technologies

Cookies are tiny pieces of data that are attached to a device browser to track and obtain certain information, enable certain features, secure the website and App, and perform other functions. 

As highlighted above, we use cookies to obtain information about your device, secure the website and App, track user behaviors, monitor violations, and remember users. Upon your access to the website and App, or your interaction with certain content, we assign cookies to obtain information about your IP address. We then use it to understand your behaviors, remember your device and settings, and monitor you anonymously. 

The types of cookies we use include:

  • Session cookies, which are used to remember basic information required for better usability and experience when you use the App. 
  • Persistent cookies, which are responsible for authenticating you whenever you come back to the App after your first download, registration, and authentication. 
  • Third-party cookies, which are cookies that may be embedded on your device by some of the third parties whose services we use (for example, Google embeds cookies to enable it to show you relevant ads on the App). 

You have a right to reject cookies from being embedded on your device. You can use the privacy settings function of the browser to accept or reject cookies. Please be aware that if you reject cookies, some functions of the Services may become unavailable. 

App tracking: Cookies are not directly used on the App; instead, we use Software Development Kits (SDKs) that help us to track conversions and analytics when you use the App. You can reject tracking on the App by resetting your Ad ID or uninstalling the App from your device. 

Other technologies: Aside from cookies, we may use other technologies, such as beacons, pixels, clear GIFs, and tags. These are like cookies, but they are embedded in our content. 

Information Uses

We use the information we collect when you use the App and website primarily to provide you with our Services, including creating your profile, identifying you, verifying your information, communicating with you, and enabling interactions with other users. 

Specific uses of your information include:

  • To enable us to provide support services, including responding to your requests, notifying you of relevant updates, and letting you know about your transactions. 
  • To enable us to verify you and secure the App, especially where we collect your phone number and other information used for identification and/or verification. 
  • To process your payments and payouts where relevant (this may include service provider subscriptions, ad page fees, and payments from Clients to Service Providers). 
  • To monitor violations of our Terms of Use and comply with applicable laws.
  • To enable us to display sponsored ads that match your interests, as well as display relevant Service Providers’ ads to Clients based on their behaviors. 
  • To protect the integrity of the Services and App. 
  • To detect crashes, bugs, and issues with the App. 
  • To enable us to determine how the Services and features on the App are doing and how we can improve. 

Information Disclosure

We do not disclose personal information except as described under this Privacy Policy or for any other purposes described at the point of collection. 

Disclosure to third-party service providers: We use third-party service providers, such as Google, Amazon Web Services, Twilio, SmileID, Paystack, Zoho, Apple and Microsoft to provide services such as determining precise location, hosting the App, enabling messages between users, enabling team collaboration, processing payments, and securing and detecting fraudulent practices. These third-party service providers may access relevant information about you to provide their services (for example, Paystack requires your card or billing information to process your payments). However, they are under obligation to use your information to only perform their tasks.

Disclosure to other users and the public: The App enables interaction between Service Providers and Clients, as well as between a team of Service Providers. Therefore, if you interact with another user, they will be able to see certain information on your profile and those shared via the messaging feature. Also, information in your content, such as your reviews, ads, and those public facing, will be visible to anyone who navigates to such areas of the App. 

Disclosure to analytics and adverts partners: We display personalized adverts on the App, and we work with network advertisers and ad agencies, such as Google. These parties may gather analytics about your use of the App on our behalf, and we may share some of the information we have collected about you with them, which they’ll use to advertise our Services to you on their platforms and across other services. 

Disclosure to sponsors: We may offer sweepstakes, promotions, and contests, which may be sponsored by third-party entities. If you register for such events, personal information about you will be available to the sponsors of such events. 

Disclosure to law enforcement and related companies: We may disclose information to law enforcement agencies with notice to you (unless prohibited) in order to comply with legal requirements, court orders, or government requests, including with respect to tax remittances. We may also disclose information to law enforcement agencies in order to protect Wokka’s rights, property, or safety or those of our users or the general public. This may include exchanging information with other companies and organizations for the purpose of fraud protection and credit risk reduction.

Disclosure under a business transfer: If we enter into a business transfer agreement (such as a merger, acquisition, sale of an asset, or a case of bankruptcy) with another entity, we may be required to disclose personal information to such an entity.

Information Security

We take the security of your information seriously and have implemented measures to protect your information from unauthorized access, use, or disclosure. These measures include:

  • developing the App to be ISO 27001 compliant, using industry-standard encryption for sensitive information.
  • undergoing annual Penetration Tests and periodic vulnerability scans to ensure the confidentiality, integrity, and resilience of the App and underlying infrastructure. 
  • reviewing and testing our security systems and limiting access to your information to only those employees and contractors who need it to perform their job duties.

Please note that no method of transmitting or storing data is completely secure, and we cannot guarantee the absolute security of your information. We ask that you also take steps in protecting your information, such as keeping your login credentials private and not sharing sensitive information over unsecured networks.

If we become aware of a security breach involving your information, we will promptly investigate and take appropriate action, including notifying you and any relevant authorities as required by law.

International Transfer of Information

We process and use your information in the United States where our servers are operated and any other location where our third-party service providers are. This means that your information may be processed and maintained on computers located outside of the United States and the location you provided it from. However, if we transfer personal information outside of the United States, we ensure the parties practice adequate privacy as this Privacy Policy. 

Retention Period of Information

Unless you request that we delete any personal information, including your profile and posts from our database, we will retain it for as long as is necessary for the purposes for which it was collected. This may include retaining your information for a period of time after you have ceased using our Services or interacting with us in order to comply with legal obligations, resolve disputes, and enforce our agreements.

If you exercise your right to delete your information, we will delete such information in accordance with applicable laws. Please note that we may be required to retain certain information for legal or regulatory purposes, even if you request that we delete it. In such cases, we will take appropriate measures to protect your information and limit its use to the specific purpose for which it must be retained.

Your Rights and Choices

Some rights regarding your information have been established in some sections under this Privacy Policy. In addition to those rights, you have these general rights below.

  • Correcting and updating your information: Most of the information you submit on the App, including profile information and payment method information can be edited within their respective pages. Service Providers can edit, add, or remove their services from their profile area at any time. 
  • Removing and deleting personal information: All users can request the deletion of their information, including payment method and profile information at any time from their profile area by deactivating their accounts. Service Providers can delete information about their services from the service page at any time. Please be aware that we may not be able to delete certain information if it will be helpful with any dispute or regulatory compliance. 
  • Opting out of personalized ads: You can opt out of personalized ads shown to you on the App by following the steps below:

 

Android: Open settings, tap “Google,” tap “Ads,” and use the slider to turn on “Opt out of Ads Personalization.”

Apple: Open settings, tap “Privacy,” tap “Apple Advertising,” and use the slider to turn off Personalized Ads. 

Meanwhile, be aware that if you opt out of personalized ads, it will not prevent you from receiving generic or non-personalized ads. 

  • Right to data portability: Certain privacy laws offer users the right to request that we transfer their information from our server to another service provider in a readable format. You can make this request by reaching out to us at [email protected]
  • Right to restrict processing: You have the right to request that we hold off on processing your information without us deleting it (for example, users may request that we deactivate their account, so it becomes invisible to other users until they request for it to be reactivated). You can temporarily deactivate your account from the settings area of your account. 
  • Right to opt out of the sale of your information: You may reach out to us at [email protected] to opt out of any sale or disclosure of your personal information to third parties for monetary consideration. 
  • Right to withdraw your consent: If we process any of your information based on consent, you reserve the right to withdraw your consent at any time (for example, you may turn off location at any time from your device settings). However, be aware that we may be unable to provide you with certain features if you withdraw your consent. 

California users

If you are a resident of California, this section applies to you. It contains provisions and rights provided to you under the CCPA, CPRA, CalOPPA, Shine the Light, and similar privacy laws. 

Under the CCPA (California Consumer Privacy Act) and CPRA (California Privacy Rights Act), you have the following rights: 

  • The right to be informed of the categories of personal information we have collected, disclosed, and used about you in the previous 12 calendar months. See below for the categories of information we have collected, disclosed, and used about you. 
  • The right to request that we rectify any inaccurate information about you. See the “Your Rights and Choices” section above to learn more about how to exercise this right. 
  • The right to request that we delete your personal information – subject to certain exceptions. See the “Your Rights and Choices” section above to learn more about how to exercise this right. 
  • The right to opt out of the “sale” of your personal information (as this term is defined under the CCPA). If we engage in this practice, we will include a “Do Not Sell My Personal Information” banner on the App, which you can use to opt out. 
  • The right to exercise any of the rights provided under the CCPA without discrimination against you. 

In the past 12 calendar months, we have collected the following categories of information: 

  • Identifiers: Including names, email address, home address, National Identification Number, and IP address. 
  • Photos and visuals: Including profile picture, ad photos, and other images uploaded to the App. 
  • Internet and other network activity: Including your search criteria, features and content accessed, and similar behaviors on the Services. 
  • Demographics: Including age, date of birth, and gender. 
  • Location and Geolocation: Including geolocation from your IP address, city and zip code from your profile, and precise location gotten through the Google Maps API at your permission. 
  • Professional information: Including the services you list on your profile as a Service Provider. 
  • Financial information: Including your billing and payment method information and transactions. 

The categories of information above have been collected automatically, provided by you willingly, and obtained from third-party sources. 

We use the categories of information for the purposes described in the section “Information Uses” under this Privacy Policy. To highlight, we have used your information to provide the Services, connect you with other users, process your payments, secure and prevent violations of our Terms of Use, and comply with applicable laws. 

We have disclosed these categories of information in the past 12 months to (i) third-party service providers, such as Google, Amazon, Twilio, Paystack, Slack, and Monday.com; (ii) other users and the public; (iii) our partners and sponsors of promotions and sweepstakes; and (iv) analytics and ad partners. 

The above rights can also be exercised via a request to our email address at [email protected]. We may use your profile to verify that you are a California user before we grant these rights. 

Do Not Track signals

A Do Not Track signal is a browser function that allows users to send a signal to Wokka to stop tracking their online behavior. 

The CalOPPA (California Online Privacy Protection Act) requires that we disclose if we respond to Do Not Track signals. Unfortunately, the Do Not Track feature is currently inconsistent among industry participants; therefore, we do not currently respond to Do Not Track signals. 

Shine the light law

California Civil Code 1798.83, also known as the “Shine the Light” law, permits California users the right to obtain from Wokka, once a year and free of cost, a list of the third parties to whom we have disclosed personal information in the preceding year for their direct marketing purposes. You can make this request if you are a California user by reaching out to us at i[email protected]

Users in the EU and similar locations 

The GDPR (General Data Protection Regulation) provides users in the EU, UK, EEA, Switzerland, and similar locations with additional disclosures and rights. 

If we transfer personal information to third parties in locations that are not termed by the European Commission to have adequate privacy laws, we rely on approved data transfer mechanisms, including, and where necessary, using Standard Contractual Clauses. 

We legally collect your information because:

  • You have consented explicitly to such collection.
  • We need it to perform a contract with you (for example, we use your payment information to fulfill Client payments to Service Providers).
  • It helps us to secure the Services (for example, we collect your phone number to verify that you are human).
  • It helps us to satisfy our legitimate interest in ways that do not override your rights (for example, we collect usage information and information about your device and behaviors to monitor violations of the Services, protect other users, and ensure the continuity of the Services). 

 In addition to the rights under this Privacy Policy, you have the right to:

  • Object to the processing of certain information;
  • Restrict the processing of certain information; and
  • Object to profiling and automated decision-making.

Children Policy

The App and the Services are made available to individuals who are at least 18 years of age. We do not knowingly solicit personal information from individuals who are below 18 years of age. If we detect that you are under 18 years of age, we will take reasonable steps to terminate your use of the App. If you are a parent or legal guardian and you believe a child (or minor) has funded us with personal information, you may reach out to us at [email protected] to have the information deleted. 

Third-Party Services

Some links, adverts, and content that belong to third-party services may be available on the App. The existence of any third-party service link, advert, or content on the App does not represent our endorsement of their privacy practices. We do not represent that this Privacy Policy governs such third-party services or that your information is safe with them. We advise that you review the privacy policies of third-party services before you visit their services. 

Changes to this Privacy Policy

As our Services evolve or applicable law changes, we may review and change this Privacy Policy from time to time. Such changes will become effective immediately upon us posting them to this page. 

We may notify you of changes to this Privacy Policy via the website, App, your dashboard, or email address; nevertheless, you are expected to frequently review this Privacy Policy to watch out for changes. 

Your continued use of the App after changes to this Privacy Policy shall confirm your acceptance of the changes made.
